Singapore Goes After Dow Jones Again Print E-mail

The island republic’s attorney general files contempt charges against the Wall Street Journal Asia for unfavorable editorials



singa-skylineIn January of 1984, JB Jeyaretnam, Singapore’s then-lone opposition member of parliament, and mortal enemy of then-Prime Minister Lee Kuan Yew, was acquitted by Senior District Judge Michael Khoo in a Singapore court of making a false declaration about the accounts of his Workers’ Party.

Shortly after that, Senior District Judge Khoo lost his job and was unceremoniously moved to the attorney-general's chambers, widely considered to be a much lower posting. The Jeyaretnam episode is the last time on record that a high-profile case ever went against any members of Singapore’s ruling Lee family or the government.

Given this unbroken record of legal victories, the Singapore government looks set to attempt to improve on it, filing contempt of court charges against the Wall Street Journal Asia for three articles published in June and July that “impugn the impartiality, integrity and independence of the Singapore judiciary,” according to the complaint. “These allegations and insinuations are unwarranted.”

One of the editorials concerned a 72-page report by the International Bar Association that has become an embarrassment both to the government and the Lee family. In a court case against the embattled opposition leader Chee Soon Juan, Lee Kuan Yew testified under oath that the Singapore Law Society had received a laudatory letter from the association, praising Singapore’s judicial system. Instead, the 72-page report, titled “Prosperity versus individual rights? Human rights, democracy and the rule of law in Singapore,” makes 18 recommendations which the association urges the Singapore government to implement as a matter of priority. 

Singapore’s government, the report continues, “is currently failing to meet established international standards in these areas.” Reports of opposition candidates being targeted for criticizing the government, it says, “are of significant concern and threaten democracy and the rule of law in Singapore.” It describes an “apparent climate of fear and self-censorship surrounding the press in Singapore,” and that the “increasing tendency for high profile and respected publications to pay large out-of-court settlements to avoid litigation with PAP officials and the continued run of success within in-court claims is worrying.”

The Journal’s editorial called the report a 'good primer' on Singapore's use of defamation suits against opposition politicians and the foreign press.

Christine Glancey, the managing editor of the newspaper, now owned by Rupert Murdoch’s News Corp., said she would have no comment and referred all questions to Robert Christie, Dow Jones corporate spokesman in New York. The contempt charges, and another case hanging fire in Singapore against the Far Eastern Economic Review, another Dow Jones publication, are rapidly becoming a test of News Corp’s nerve. It is the first time News Corp, which in the past has shown little stomach for taking on governments, has come up against the immovable object that is the Singapore regime, as other publishers have, usually to their sorrow.

The decision to file contempt charges comes a few days after another Singapore judge, Justice Woo Bih Li encouraged lawyers for the Prime Minister Lee Hsien Loong and his father, Minister Mentor Lee Kuan Yew, to amend their defamation petition against the Far Eastern Economic Review to make sure they included Woo’s own more defamatory reading of an article about the two ministers. Woo’s ruling, two years after the filing of the original charges, appeared to be unprecedented.

Singapore and the Lee family have long been famous for suing journalists, both foreign and domestic – and they have never lost a suit in Singapore. The Far Eastern Economic Review was a favorite target. The media watchdog organization Reporters Without Borders ranks Singapore 140th out of 167 countries surveyed in terms of freedom of the press. The country has been kicking foreign journalists out for writing critical articles about the republic since the early 1970s.

An official enquiry requested by Jeyaretnam into allegations of executive interference in judiciary appointments in the wake of Khoo’s demotion found that there was no truth to the claims. In fact, Justice T S Sinnathuray, the sole commissioner who examined the case, said: "The wholly unfounded allegations of Mr Jeyaretnam (of executive interference) were scandalous statements that should never have been made."

There he goes again, clucking away at the world - this "kampong chicken" called LKY. He has this terrible urge to sue and sue and------. And make money from it too. Too bad nowadays he doensn't claim to donate all of it to charity(he never did in the past). The AWSJ can never win. Even if it is true, the AWSJ is guilty of soiling the already soiled name of the judiciary. Like the case of the American lecturer about 10 years ago. What readers should look out for is that there will be no open court hearing with LKY taking the witness box. Everything will be in chambers. LKY will NOT step into the witness box - by hook or by crook. He will probably schedule a meeting overseas on that date. Notice this time that he has not challenged anyone to cross examine him.

Lee Kuan Yew and family are well known for using their appointed Singapore judiciary to silence and bankrupt their opponents. The way Singapore First Family uses the Singapore courts are just as bad as the Malaysian UMNO uses ISA against any opponents.

AWSJ, THE ECONOMIST and FEER, 3 major publications have been sued by LKY in his backyard and the outcome is well known. IBAHRI have made it very clear in their report that the Singapore judiciary is not independent. LKY is the LAW in Singapore.
The 3 major publications should work together with IBAHRI and highlight their past/present legal law suits at the UN and The World Court. An open debate/forum with LKY and his judiciary should be organized. Only political cowards will not debate publicly.

Wow, now they have passed a mental incapacity Bill in singapore. You can nominate somenone to take full legal responsibility of all your affairs/property/monies etc, if and when you should become mentally incapacitated sometime in the future. This rings alarm bells. Who is lying in coma at this moment and who is immensely wealthy? No prizes for the right guess.

Why not highlight the idiosyncrasies and hypocrisy of the West then? A discussion like this on the global stage will inevitably lead to criticisms and exposure of the West's alleged human right abuses as well.

Why not focus on yourselves first. Since you apparent care a lot about 'true' democracy and political freedom, why not eradicate it in your backyard first? Why judge countries who, at best, not committed 'human right abuses' that are more serious than the West?

It goes without saying that Westerners, or de-facto Westerners are judging countries by their equally flawed yardsticks.

And to Singaporeans here, why bite the hand that feeds you? If you are so concerned about it, why not organise a debate with ministers? Why do nothing but to curry empty support earn favour with the West when people like you should be the ones leading the charge. Form/join a political party. Why be so hypocritical and not back up your views with solid action?

Having lived in Singapore for decades, I can say that the climate here is much looser now, albeit if there are a still rules here and there. Why say the judiciary is soiled? Are you saying that all the ranking organisations are soiled as well? Or are you saying that the Lees bought over them? I don't think so!

Well on a side note, there are stories emerging about how top firms and banks are not as holy or inviolable as they seemed. There's a lot of unethnical stuff going on there - remember, they don't give a damn about 'fairness' or democracy. Its a dog-eat-dog, profit maximising world out there.

I ditto Catarat.

There is no perfect State in this world, neither a perfect government. I think if we expect to run our country like USA (wow, freedom of speech, lots of freedom but also high unemployment and dis-equality of wealth and lots of junk in the lives and streets), then we cannot expect to be what we are today. The Hollywood dream is actually a HYPE... it used to be good but now it only looks good on the outside lah.

The government led by MM LKY has at least produced lots of visible results - there is no HYPE in his approach. I lived overseas for some years and have visited more than ten countries, my oh my, the low crime rate we have here is non existent in those countries (if not for his strong stance on corruption and crime). Imagine having to worry about our children or husband every day. What's the point of having freedom of speech and lots of so-called human rights?

I guess there is a price tag for everything. Yes, even for what Catarat mentioned. I can assure you we have A WHOLE LOT of what we can't get in 95% of this world. Should be contented liao and thank God everyday.

For whatever MM Lee and the ruling party did (whether right or wrong - obviously not everything was done right), the result should speak of itself. I guess it stemmed from the point of view that a country cannot have too many chefs, esp. a very small country. If the Lee family doesn't go after those guys in the press one by one, many will start believing the exaggeration and we start to have chaos like neighboring countries (Malaysia, Thailand, Indonesia, etc. - these have real serious issues that we dun have). Then our children get happy cos they have "holidays" and then we will start to worry.

I lived in one country for a year, during that one year, I got to know quite a number of families. Do you know that everyone of them has at least one family member killed in a road robbery? But those are just people I knew, there are lots that I did not know. So, imagine the number... Within that one year, I also had one neighbor killed because of car theft and my own house broken into. That's just one year's time.

Would you exchange that for life in Singapore? Cannot compare lah... We cannot even compare with our neighboring countries, Malaysia, Thailand, China, Indonesia... people suffer under inefficient governments that talk and talk while the people suffer and suffer.

I think we give the current Government the support and focus on giving our best. Or else how? Everybody suffer lah... our wives, our children, our old parents.

Oh, lets not listen to the overseas politicians too much, especially those very near us. They have not done anything to improve our lives yet continue to criticize our system and talk nonsense. They first need to learn how to earn the respect of their own people and get some results before commenting. They cannot even control their own crowd leh...

Look at the progress that Singapore has managed to achieve! Look at the good infra structure, schoollng system, health care and housing policy!

Sickening sycophants

This horde of LKY sycophants praising the governance of LKY only make things worse for LKY. It's the duty of every government to provide for and look after it's people. All the "desirable" things quoted by the sycophants is only to be expected. It is by default the duty of every government to do so. Because it does so, doesn't mean you can stay on and on and abuse your power(like LKY). Like good doctors, once you start making mistakes, you get out of the scene. Doctors get struck off the register for negligence(like lawyers). Politicians are thick skinned and in many instances, become psycopathic. What's the reason for staying on in power for 40 years? You mean no one else can govern like LKY, or BETTER?. He is like the proverbial actor who doesn't know when his role is over and keeps hogging centre stage. He keeps giving excuses for his mistakes - someone else is always the culprit. Even the apple of his eye, LSL is becoming a lame duck PM. Anybody else and he would be gone in a flash. Singaporeans should agitate for a change in the constitution to allow for only 2 terms. The reasons are obvious. We don't want another LKY, LSL or any of the Lees again, EVER! WE want people who SERVE the country, not themselves or their cronies. WE want people who understand the poor and downtroden and have the courage to look after them. We don't want politicians who consider these people as a source of irritation and a nuisance. Perhaps God is great after all, as the Lees won't be around much longer. What man is unable to do, GOD will intervene.
