Singapore's Lees Win a Case Against a Defunct Magazine Print E-mail

As expected, a three-judge appellate panel has upheld a ruling that the Far Eastern Economic Review defamed Prime Minister Lee Hsien Loong and his father, former Prime Minister Lee Kuan Yew, in a 2006 interview with Chee Soon Juan, the long-suffering secretary-general of the opposition Singapore Democratic Party.

The Lees sued editor Hugo Restall and Review Publishing Co. over the article, which described Chee's marathon battles with the Lees and the ruling People's Action Party, and a series of court cases, all won by the government, that left Chee destitute. It quoted him as saying, among other things, that the Singapore government would never change course until the elder Lee was dead.

In addition to suing the publication and editor Restall, the government also later banned the Review, which at that time had more than 1,000 subscribers in Singapore, because the magazine hadn't appointed a legal representative or paid a $126,150 security bond -- new requirements that at the time were unrelated to the lawsuit, but that the Review called unjustified.


In the 204-page concurrence by Chief Justice Chan Sek Keong, Appellate Justice Andrew Pheng Boon Keong and Judge Judith Prakash, the three agreed with the Singapore High Court's ruling last September that the two had been defamed, dismissing the appeals and awarding costs “and the usual consequential orders” to the Lees. Decisions by the Court of Appeal are final.

In all, it was a routine judgment in favor of the Lees, who have never lost a libel case in their own courts. Being charged in the Singapore courts is tantamount to being convicted. The government or the Lee family have filed defamation or contempt charges against virtually every major publication in Asia, including the International Herald Tribune, the Financial Times, Time Magazine, the Economist, the now-defunct AsiaWeek and any other publication that refuses to toe the Lee line.

The bigger question, however, is what becomes of the lawsuit. Two weeks ago, News Corp., controlled by Rupert Murdoch, announced it was closing the 63-year-old FEER, once the leading regional magazine in Asia, in December. The charges against the magazine, which was converted to a monthly publication of analysis and comment five years ago, were considered a test of News Corp's nerve. It is a news organization that in the past has sought to steer clear of controversies with governments. The announcement that the magazine would close was in fact seen by skeptics as a maneuver by Murdoch to nullify the lawsuit or as a quiet capitulation to Lee Kuan Yew, who staged a long series of lawsuits and other battles with the magazine and particularly with its onetime editor, the late Derek Davies. Although the Review no longer has assets in Singapore, its parent company, Dow Jones Co. does.

In an abbreviated e-mail, Restall said the closure would not affect the suit. "The suit goes on regardless," he replied. To the suggestion that Murdoch might have closed the magazine in deference to the Lees, he said: "That doesn't make any sense."

In announcing the closure, Dow Jones said “continued losses in advertising revenue and readers are now unsustainable.” Killing off FEER, the company said, would allow “opinion and commentary resources from Asia” to expand across all Dow Jones properties. Restall, the company said, would keep his job on the editorial board of the Wall Street Journal and the staff would be offered jobs elsewhere in the company.

As for the FEER brand itself, a spokesman said that “We may at some point revisit it, but not likely any point in the near future.” Circulation, the spokesman said, had shrunk to about 20,000 from its heyday of 90,000-100,000. At one point, the magazine had the biggest staff of correspondents of any news magazine in Asia.

The media watchdog organization Reporters Without Borders ranks Singapore 140th out of 167 countries surveyed in terms of freedom of the press. The country has been kicking foreign journalists out for writing critical articles about the republic since the early 1970s.

Lee made the schoolyard bully's elementary error of using his fraudulent defamation lawsuits against his critics once too often. The result is that he's now looked upon with the kind of disgust reserved for when you step on something nasty like dog poo.

He weaponised the rule of law in his fiefdom, Singapore, and his kangaroo courts and the cowardly, self-serving judges that do his bidding have about as much respect and credibility as he does, which is to say none at all. So much do his people love the decrepit old man that not less than 10 bodyguards have to accompany him wherever he goes in his own kingdom.

FEER and Dr. Chee are perfectly right in saying that Lee's death is a necessary but insufficient condition towards righting the dreadful damage by done to Singapore by 50 years of his dysfunctional brand of politics. His final act, to attempt to turn the island into an outpost of China by throwing open the floodgates to unrestricted immigration, will fail, as so many of his previous social engineering schemes have miserably failed.

The great pity is that he won't be around to rue the aftermath and FEER won't be around to report on it.

The Singapore will be very wrong to think that just by suppressing the printed press, that it can control free flow of information. Sure it must be very worried after seeing what happened in Malaysia. With a discredited press that is controlled by the government, the Malaysia people turned to the internet for information. The free flow of information in the internet contributed significantly to the big setback for the BN government in Malaysia. The Singapore government can suppress FEER and similar others, but it can't prevent information flow in the cyber age. Maybe the Singaporean Kiasus may not be as brave as their Malaysian brothers and sisters in challenging their authoritarian government now, but when the bread and gravy on the table shrink, maybe they just may follow their brethren next door.

I do it all the time. Saves time and headache. My sycophants and agent provocateurs are doing a great job informing me 24/7 what is happening around me. The verdict on LKY~80% positive & 20% negative. All in all, LKY's Singapore is an inspiration to Chinese worldwide, never mind his authoritarian leanings. The only thing which mainland Chinese hate most about him & Singapore is his too ultra pro-West national psyche & blind idolisation of the English language & thing Western. It is eerie to listen to so many 2nd & 3rd generation Chinese Singaporeans speaking Singlish as their perceived mother tongue conveniently downgrading Chinese as an authentic/original mother tongue. Mind you, the white folks will never ever accept Anglonised Chinese Singaporeans as their own no matter how polish you guys can master the English language. Now even the Japanese are rediscovering their Asian root thus wanting to return to the Asian fold, it is high time for these pseudo S'porean Chinese to ponder seriously about their root & return to their authentic Chineseness.

"movemountain" is correct. All you singaporeans get out. Me and my friends are moving in. We are now 33% of the population.Soon we will be 50%. What a great country. This is the only country where the government actually tells its people to get out if they don't like it. Why don't the government get out if the people don't like them! Look at Japan and Korea and H.K. The government is respectful of the wishes of the people. But in Singapore they are derisive of their people. They are pompous, self righteous and derisive. They talk of creativity but there is a catch. So one by one every one is getting out. What a sad day for Singaporeans who were born and bred in Singapore but asked to get out by the government of LKY just because you don't like them. Lucky for those who got out, some get persecuted quietly. This is a government by a despot who hates anyone who disagrees with him. Policies which hurt the people are good policies - any policiy which make the people happy is a dangerous one. Hence you poor guys, keep on suffering.Hey, I shouldn't be complaining. I am here to make a living. The more Singaporenas get out the better my chances of success are. Do I want citizenship? Sure. The Singaporeans are all NATO ..No Action, Talk Only. Come the next general election, they will vote for PAP headed by the Lees, again! You see, the Singaporeans are all Kia Su, Kia See, Kia Cheng Hu, Kia Boh, Kia Bor...! SO if you Singaporeans keep on voting in the PAP, decades after decades, then you should not be complaining. The government of the day was elected by you SIngaporeans. They are your choice. My forecast is that you will still vote in the PAP in he next GE! Now why did the PAP government bring in so many talents? Because there is lack of talent in Singapore lah. Every SIngaporean who has worked for two years think he/she is already a manager stuff when they are actually all still green horns and only good at talking and doing power point slides. If not for the import of foreign talent, the corporations there will come to a stand still, of the head office of MNCs will move out. So you need foreign talent to be constantly imported. So please say thank you to your PAP government for having that foresight to bring us foregners in!!!

More Chinese is good for Singapore

Singapore is surrounded by hostile Islamic neighbours. A tiny dot is quite easy to be over-run.
So by importing tens of thousands, or hundreds of thousands of China nationals into the country, and having billions of dollars of China money invested here, China will have a very high vested interest here in Singapore, and would not allow the itchy neighbours to touch Singapore. They would be fearful of China's reprisal. So you see your PAP government is not that stupid as you think. Also Singapore is now the Switzerland of Asia, where almost every dirty dictator in the region has parked some of their ill gotten wealth in SIngapore. So each of these dictators would pray that his money is safe and sound in Singapore and nothing happens to SIngapore. So you Singaporeans better vote for PAP again!! Hahaha you would not know what to do next if you have a new government!!! And if you cannot compete with the China nationals , then time for you to migrate to a white man country who you worship so much.

Singapore is the beacon in SEA

Singaporeans should not be too hard on themselves. For whatever faults SIngapore has, it is still the most successful country in South East Asia. You can bet that the SEA neighbours are jealous of Singapore's success. Of course they will not admit it. And then they look for little things to laugh at. But Singapore outstrip them in many many things that count. Quality of life, Income level, medical care, lower crime rate, job opportunities, job mobility, lower corruption rate, etc. SIngapore had benefited tremendously from immigrants, especially from Malaysia (the most) as well as from many other countries. Sure Singapore made some mistakes in the financial investments. But which country did not? Only those which had nothing to invest were spared. People from other countries make fun of Singapore because they are jealous. So you folks in Singapore, be thankful for what you have. You won't realise how lucky you are until all those things disappear. But guys and gals of SIngapore, please don't be such a bitch, and please stop stealing your neighbours inventions and calling them Singaporean!

If Singaporeans think they have a lousy government, then they just need to look across their immediate borders and see if the other side is greener. You should be thankful to God that you were born in Singapore, or that you or your parents had the foresight to migrate to Singapore!
And no, I am not a PAP supporter and not related to Lee. I just happened to be born next door to SIngapore. Our government is not clean. Our public institutions are not clean, and not efficient, but very bloated and lazy. Things don't work when they should be. Sure we are trying hard to change the government, or the way they work. But it is easier said than done. So SIngaporeans, please say a prayer to thank God that you are living in a place where things do work quite well and that you are among the wealthier citizens in this region, even though you may not be a billionaire. But do count your many blessings.

Singapore is the most repressive country in Asia. No wonder its citizens are leaving by the thousands. I feel so sad for the people here. They are like slaves working day and night without rest for the authoritarian government.

Hey, look at the discriminations happening in countries that profess freedom of speech and freedom of press. These are the big boys who try to brainwash little nations so their MNCs invading the world can get more money from you when you think their way. What is freedom when you fear for your safety as you walk down famous city streets?
It is easy to blame a government. But just ask majority of Singaporeans - what is the repression about when they can join the world in criticising the very people who deliver them from real oppression and give them a stable country to live in?
Be thankful and don't pick bones.
