 Trial gets underway in a case designed to sideline the opposition leader permanently
Malaysian opposition leader Anwar Ibrahim went to court today in Kuala Lumpur on charges of sodomizing a former aide in a trial that to everybody but the government itself appears to be built on dubious allegations that were laid to derail the first realistic challenge to the ruling national coalition since the country was formed. The trial takes place in an increasingly shaky country, with a sclerotic government faced with a challenge not only from the formal opposition but from a fast-growing Malay nationalist movement, an NGO called Perkasa, which looks as if it is seeking to tow the United Malays National Organisation, the leading ethnic political party, into a violent confrontation with the Chinese community over so-called Ketuanan Melayu, or ethnic Malays-first rights. Police warned against illegal gatherings in connection with the trial. Anwar, most impartial observers feel, is virtually certain of being railroaded into jail on the current charges unless the judiciary shows some uncharacteristic backbone. If he is jailed, even a short sentence is likely to end his political career. The appeals process could take as long as two years, court observers say. Where that leaves the country is open to question. If he remains free on appeal, Anwar, who has led rallies all over the country in recent weeks to large crowds, could well return to his previous status as a political martyr, which he was during his previous jailing on similar charges in 1998. At this point, there is no real viable opposition political successor to Anwar waiting in the wings. Attempts to groom them have fallen apart on political infighting. The opposition coalition has been reeling from a series of defections, missteps and intense pressure from the Barisan Nasional, the national ethnic ruling coalition, which has used its political power in a variety of ways. The case against Anwar was briefly adjourned while his lawyers sought to review an earlier decision denying him access to prosecution evidence. A chaotic scrum of reporters, photographers and supporters greeted the 63-year-old head of Parti Keadilan Rakyat, or the People's Justice Party as he and his lawyers entered the court. At best, the charges appear to be a selective prosecution in a country in which a long string of top politicians have been complicit in a long string of crimes, not just of murder or assault but massive corruption. Najib Tun Razak, the current prime minister as defence minister engineered the purchase or lease of three French submarines that netted his best friend €117 million in commissions. That was just one of a variety of questionable defense purchases during his reign. The aide, Mohd Saiful Bukhari Azlan, is acknowledged to have been photographed with and met with Najib after the supposed sodomy took place and before he filed the charges against Anwar. Dr Mohamed Osman, who examined the then 23-year old Saiful at Hospital Pusrawi Sdn Bhd on Jalan Tun Razak in Kuala Lumpur on June 28, 2008, filed a medical report that found no evidence of tearing or scarring that would indicate the youth had been sodomized. When Saiful went to another government hospital to obtain a diagnosis, doctors at that hospital refused to confirm that he had been sodomized as well. Nonetheless, Saiful filed the assault report four hours later at a nearby police kiosk. Police later picked up the doctor and held him for three days, according to the website Malaysia Today, following his filing of the report that no assault had taken place. The doctor later went into hiding with his family. In an abbreviated interview with Asia Sentinel at the time, Deputy Inspector General of Police Ismail Omar confirmed that Dr Mohamad had been questioned, but said he had not been detained. The charges against Anwar echo those that took place in 1998, when he was leading the charge against the government led by the United Malays National Organisation and the then-prime minister, Mahathir Mohamad, who had fired him as finance minister and deputy prime minister. The charges have been widely reported as spurious. The supposed victims of Anwar's sodomy later recanted all of the charges and said they had been tortured and beaten into making them. Munawar Anees, an internationally respected biologist, was one of four men accused of having sex with Anwar. The others were Anwar's adoptive brother, his wife's driver and a fashion designer. Anees wrote extensively in a statutory declaration of the five days of torture, brutality and deprivation he had suffered prior to being forced into making the charge. The declaration was published in Asia Sentinel on Dec. 9. It can be found here. The prosecution, faced with contradictions in testimony, repeatedly changed the dates and times the alleged sodomy had taken place. Nonetheless, Anwar was convicted on charges of abuse of power and sodomy and served six years in jail before Mahathir left office and his successor, Abdullah Ahman Badawi, came to power. The sodomy ruling was overturned by the courts in 2004. Anwar was suspended from running for political office until 2008 because of the abuse of power charge. He almost immediately became a major force in Malaysian politics, cobbling together a disparate coalition of the Democratic Action Party, a largely Chinese left-of-center party, Parti Islam se-Malaysia, a fundamentalist Islamic party, and his own moderate, urban, largely Malay Parti Keadilan, and for the first time broke the national ruling coalition's 50-year two-thirds hold on parliamentary power. The opposition leader was arrested a day after a nationally televised debate that most observers thought made his opponent look incompetent and out of touch. When Anwar refused to give a DNA sample, charging previous samples had been used in the spurious 1998 case against him, the Barisan pushed a bill through the Dewan Rakyat to allow police to collect samples in criminal cases without the consent of the suspect. Since that time, the charges against Anwar have been modified from forcible sodomy to consensual sex. Saiful, however, has never been charged although presumably he had consented to homosexual sex, a violation of Malaysian law. He has remained sequestered by law enforcement and unavailable to the press.

UMNO is a home grown terrorist organization that is single handedly destroying the nation. Its only a matter of time before Malaysia is burnt by the decisions of their current self proclaimed leadership. From the Sultans to the Prime Minister to the corrupted kangaroo courts. There is just no where else for the people to turn to. There is no where for them to escape short of leaving the country and abandoning it forever. I pity those whom are left behind. What options do they have left?

Dear Kassim, I share the anger and pain. I do understand where you coming from. Out of anger and frustration, we left Malaysia several years ago and now we reside here in a great country called America. We love America, a Christian nation that tolerates our Muslim faith. We find more freedom to practice our faith here than was in Malaysia. We couldn’t tolerate racist government like Umno. Not all Umnos are pariahs. I have personally known some good Umnos who have tried to bring changes but lost everything in form of contract and position. Umnos in umno are afraid to voice out due to unknown retaliation in within. I don’t blame them. Its all money talk.

I truly believe it will come a time, when enough is enough and our great king will up rise and do the house cleaning. I have a great faith on him. The reason is majority of umnos are made of Indian muslim (pariah background... its known that inorder to escape from the stupid caste system, majority of pariah Indians converted to muslim. example... Mahathir's father, Penang muslims, the kelings that were acting rowdy recently and many more umno people) and Indos. The real Malays are the people like Anwar. So now you know the rest of the story and why Malaysia has the most dummiest government, umno parisah in the world. Its only in umno, they use a gay's arse to bring an opposition by down. Not by election. if you are an umno pariah, you should be very ashamed of yourself. I swore in quran, I would hang myself. That is most humiliating to be an umno pariah. The 9/11 murder killed many Muslims who had the hope in the United States for a new life-that they will not suffer poverty, their children will receive a good education and on merit they will succeed in business through hard work. If you look at the list, so many Bangladeshi cleaners where killed. They believed in Allah! Even the poorest have rights-the meek will inherit the earth in that country. They have a black President after more than 200 years of slavery. What a FANTASTIC COUNTRY-Can we see Muslims Malays in the future voting a true, patriotic Indian or Chinese to be Prime Minister. That will not happen unless, Najib decides like Abraham Lincoln and Johnson to change the Constitution and law and make “Every Citizen Equal” But UMNO members are supporters don’t want that; they justify terrorism against the United States and have been anti-Americans for many years? They are a RACIST party, ANTI-SEMATIC and a dangerous organization that has escaped the radar of the West. I am happy that the World now recognizes this –so it’s important when French companies paid millions to Malaysian Muslim politicians for the submarines, they may be funding an organization that does not have the interest of the world on its agenda. It wants to stay in power. Malaysia does not want democracy. Democracy will demand transparency and many who are in power will be in jail. There are no exceptions. Sad that Chinese and Indians have suffered for more than 50 years. This includes the indigenous people in Peninsular Malaysia, Sabah and Sarawak. Today Islamic fundamentalism is an international problem. Many Governments use this to unite their citizenry to stay in power. One very good example is Pakistan. But that disease is a loose canon. Today the Devil runs it in the Taliban. Malaysian politicians are doing everything to cause racial unrest to stay in power. Regime change peacefully is possible if and only if the International community helps. Expose stealthily the wrong doings in Malaysia. Show us how much money is stashed all over the world. At least be transparent to Malaysian of all religions who are kind and wonderful people. We want another American in Asia! Malaysian Indians and Chinese when they arrived in Malaya (as it was then) were neither BEGGERS nor SELLING their bodies. How arrogant the Malays have become. UMNO will not do anything but stir up racial problems to deflect the attention of their bad governance. If the Chinese women came to sell their bodies, then most of the Malays leaders are BASTARDS. Najib will not do anything because UMNO wants another May 13, 1969! We hope that Malays will stand up and have the vile politician to be charged under Malaysian draconian Sedition Laws. This is a simple case of a Malay Class war-Many Malays are discriminated in Malaysia If you dont support UMNO or in the mix with the elite, there will be nothing for you. The NEP was a vehicle to enrich and empower Mahathir and his Cronies-Najib, Badawi, Hishamuddin and Non-Malays who reward UMNO’s with funds for projects-YTL, Berjaya, and Tanjong etc. I can’t blame the latter. On the other side you have strong academia that have been marginalized for thinking too much or not favoring UMNO and can see the cheating going on. Many young Malay/Bumiputra citizens who have been educated overseas are shut out in the democratic participation in the governance of the country-They can see the Corruption, No Transparency and Bad Governance. But can’t do anything. If they tried they will be incarcerated like the Non-Malays. This is GROUP 2. This group also has the leadership of Anwar who has married a DEAF Goat with a Blind Cow- DAP and PAS. So do you see the difficulty? So the Non-Malays and Malays who want to shout out loud their disaffection are censured, punished and without trial detained by the 1 st Group. So in order to get GROUP 1 and 2 together, it would be in the interest of UMNO to instigate racial problems-Remember 1969, when the elite and Royalty controlled business and the Padi Farmers of Malay origin were so fed up with the middle men making all the money-Same here-lah in 2010.In that case, Harun MB (UMNO instigated racial riots. This is what the BN Government wants. What we need to do is as Malaysians-Never accept violence as the answer. We have to remove this government peacefully and democratically-This can be done if Malaysian UNITE! UMNO and it supporters have invested so much in its leaders that they would prefer that the country go to the dogs together with Malays and Non-Malays than allow for good governance of Malaysia.If Malaysian dont take the cue and chnage the government it fault can only lie with Malaysians.Never be allowed to be divide by race or religion-everything must be on merit-we need good governance and that requires intelligent, uncorrupted people at the helm. 'm pleased to share with everyone here my thoughts and rebuttals on this first day of Saiful and Solicitor-General II< Mohamed Yusof opening testimonials which are filled with flaws on day 1.

1. It was alledged that the act of sodomy was between 3.01pm. and 4.30pm. - The complainant left the condominium at 4.00pm. (It seemed that he left the condominium way before finishing the act). 2. Semen stain was claimed to be Anwar's when Saiful went for a medical examination at the Kuala Lumpur Hospital on 28th June 2008 by a doctor who took Saiful's tissue sample for DNA testing. - Between 26th June 2008 and 28th June 2008, where was Saiful? Didnt he took his bath or clear his bowel on a daily basis? Arrangement could have been made for Anwar's DNA to be planted on Saiful's tissue sample between this 2 dates. Was the tissue sample taken from Saiful's anus? It is more likely that the DNA has long been kept by the examining doctor who is/are also one of the conspirators who had obtained Anwar's DNA by unscrupulous mean when Anwar was first imprisoned for the first sodomy sentence. 3. Forensic Doctors and Chemists to testify on behalf of the government. - It's very obvious that they are all government servants working for the government where their livelihoods depended on their jobs so must be bias. Fine example is the forensic pathologists from the government hospital who conducted a post-mortem on Teoh Beng Hock. 4. If an act of sodomy was done against Saiful's will, why was there no complain of a struggle or free himself from the clutches of Anwar and ran out of the condominium at once to the police station to lodge a report against Anwar so that any sign of injury from a struggle to free himself could be recorded by the police. Why waited for 2 days to have a medical examination at the Kuala Lumpur Hospital carried out.? Was there any other injury found on Saiful's body apart from his anus, if any? Good point. Saiful is younger and stronger than Anwar, so he could not be sodomised without his own consent. If Anwar is really guilty, then Saiful is also equally guilty and should get the sentence as Anwar. report abuse

The ruling Malays are hipocrites-they say they are Muslims but banyak wang comes from Genting Highlands-Gambling and its OK that the Former IGP is the Chairman-his millions paid to him are not Haram-what a joke.Help Malays,Chinese and Indians be rid of this government-Its a bad Government-support the opposition.

I am glad that Malaysian can see the dishonesty of the Malaysian Government. The Chief Minister of Selangor ( TOYO) is walking around quite freely when evidence is available in the net that he his corrupt.Hey, how come a civil servant can have a house 20 Million$$$ -that is only one -many more-look at the CIMB Bank account! Banyak..Duit untuk Bumi putra...Lagi CM dari Malacca ( EX) Rapist boleh ( can ) still walk around doing business, Rafidah and Nazri ( accompolices of Mahathir, now fallen Angels) still have power cheating the Malays...cheating the Malays-talking very big.

How can you sustain the charges against Anwar Ibrahim??? How does Najib Tun Razak and his Relative ( Hishamuddin Tun Razak @ Hueesin Onn) like Sadam Hussein and Mogabe or disgravce his fathers name , his legal background and his call to the UK Bar-arrest and detain Anwar. Hey, I dont like Anwar but its not fair to put him in Jail. Not fair to have a case when no evidence, HOW MANY PRISONERS IN JAIL WITH NO EVIDENCE-We want Shaik Daud to be the Judge-not some PARIAH!! WE WANT JUSTICE-when you BEAT the Deputy Prime Minister, CHEAT the People -we dont trust Najib! From your article ( and many others all over the world), it is CLEAR that the crime of corruption and criminal breach of trust has occured.Mind you this is Government procurement and only Bumiputras can have this contract.No Indian or Chinese can participate-althought its discriminarory, neither China nor India wants to care-BUT the UNITED STATES will never support racial discrimination.

My question is -why when the French government is arresting former dignatories etc etc for acts of corruption in Congo etc, why is nothing being (a) Said in explanation to the Malaysian Public-that the French authorities are abbeting an offence in Malaysia (b) taking no action whatsoever, but invite Najib for a treat in France/Paris where he shopped with his wife-probably all the money changed hands with his crime partner. We demand an explanation from the European Union, we hope under the Foreign Corrupt Practice Act that the USA will examine whether any monies when through EU acoounts and via US Banks and have the individuals arrestsed. I am not seeking anything but to arrests anyone who is complicit/Abbetted thsi grave offence to the Malaysian people!! I think this will do wonders for the European Unions demand to end corruption all over the world. I hope that the French government will help malaysia! report abuse
