![]() Murky arms deal linked to international pattern of kickbacks A potentially explosive scandal in Malaysia over the billion-dollar purchase of French submarines, a deal engineered by then-Defense Minister Najib Tun Razak, has broken out of the domestic arena with the filing of a request to investigate bribery and kickbacks from the deal in a Paris court. Although the case has been contained for eight years in the cozy confines of Malaysia's courts and parliament, which are dominated by the ruling National Coalition, French lawyers William Bourdon, Renaud Semerdjian and Joseph Breham put an end to that when they filed it with Parisian prosecutors on behalf of the Malaysian human rights organization Suaram, which supports good-government causes. Judges in the Paris Prosecution Office have been probing a wide range of corruption charges involving similar submarine sales and the possibility of bribery and kickbacks to top officials in France, Pakistan and other countries. The Malaysian piece of the puzzle was added in two filings, on Dec. 4, 2009 and Feb. 23 this year. For two years, Parisian prosecutors, led by investigating judges Francoise Besset and Jean-Christophe Hullin, have been gingerly investigating allegations involving senior French political figures and the sales of submarines and other weaponry to governments all over the world. French news reports have said the prosecutors have backed away from some of the most serious charges out of concern for the political fallout. The allegations relate to one of France's biggest defense conglomerates, the state-owned shipbuilder DCN, which merged with the French electronics company Thales in 2005 to become a dominant force in the European defense industry. DCN's subsidiary Armaris is the manufacturer of Scorpene-class diesel submarines sold to India, Pakistan and Malaysia among other countries. All of the contracts, according to the lawyers acting for Suaram, a Malaysian human rights NGO, are said to be suspect. With Najib having moved on from the defense portfolio he held when the deal was put together in 2002 to become prime minister and head of the country's largest political party, the mess has the potential to become a major liability for the government and the United Malays National Organisation. Given the power of UMNO, it is unlikely the scandal would ever get any airing in a Malaysian court, which is presumably why Suaram reached out to French prosecutors. "The filings are very recent and have so far prompted a preliminary police inquiry on the financial aspects of the deal," said a Paris-based source familiar with France's defense establishment. "There isn't a formal investigation yet. The investigation will most likely use documents seized at DCN in the course of another investigation, focusing on bribes paid by DCN in Pakistan." The source said police have confined their inquiry to bribery allegations so far and have not looked into the 2006 murder of a Mongolian woman in Malaysia who was a translator on the deal for Najib and his friend, Abdul Razak Baginda, during a visit to Paris. There have been numerous deaths involving DCN defense sales in Taiwan and Pakistan. Prosecutors are suspicious that 11 French submarine engineers who were murdered in a 2002 bomb blast in Karachi – first thought to have been the work of Al Qaeda – were actually killed in retaliation for the fact that the French had reneged on millions of dollars in kickbacks to Pakistani military officers. The Malaysian allegations revolve around the payment of €114 million to a Malaysia-based company called Perimekar, for support services surrounding the sale of the submarines. Perimekar was wholly owned by another company, KS Ombak Laut Sdn Bhd, which in turn was controlled by Najib's best friend, Razak Baginda, whose wife Mazalinda, a lawyer and former magistrate, was the principal shareholder, according to the French lawyers. "Over the past years, serious cases have been investigated in France by judges involving DCN," lawyer Renaud Semerdjian told Asia Sentinel in a telephone interview. "This is not the first case of this kind that is being investigated. There are others in Pakistan and there are some issues about India. To a certain extent, every time weapons of any kind have been provided, suspicion of violation of the law may be very high." As defense minister from 2000 to 2008, Najib commissioned a huge military buildup to upgrade Malaysia's armed forces, including two submarines from Armaris and the lease of a third, a retired French Navy Agosta-class boat. There were also Sukhoi supersonic fighter jets from Russia and millions of dollars spent on coastal patrol boats. All have come under suspicion by opposition leaders in Malaysia's parliament but UMNO has stifled any investigation. Asked personally about the cases, Najib has responded angrily and refused to reply. Despite efforts to bury it, the case achieved considerably notoriety after the murder of Altantuya Shaariibuu, a 28-year-old Mongolian translator and Razak Baginda's jilted lover, who participated in negotiations over the purchase of the submarines. By her own admission in a letter found after her death, she was attempting to blackmail Razak Baginda for US$500,000. She was shot in October 2006 and her body was blown up with military explosives by two bodyguards attached to Najib's office after Razak Baginda went to Najib's chief of staff, Musa Safri, for help in keeping her away from him. Not long after being acquitted in November 2008 under questionable circumstances of participating in her murder, Razak Baginda left the country for England. The bodyguards were convicted but no motive was ever established for their actions despite a confession by one which was not allowed in court, but which said they would be paid a large sum of money to get rid of her. The submarine deal was never brought up in court during a months-long murder trial that was marked by prosecutors, defense attorneys and the judge working studiously to keep Najib's name out of the proceedings. A private detective hired by Razak Baginda to protect him from the furious Altantuya filed a statutory declaration after the trial indicating that Najib had actually been the victim's lover and had passed her on to Razak Baginda. The detective, P. Balasubramaniam, said later that he was unceremoniously run out of Kuala Lumpur. He eventually emerged from hiding in India to say he had been offered RM5 million (US$1.57 million) by a businessman close to Najib's wife to shut up and get out of town. He also said he had met Nazim Razak, Najib's younger brother, and was told to recant his testimony. In the current complaint in Paris, the issue revolves around what, if anything, Razak Baginda's Perimekar company did to deserve €114 million. Zainal Abidin, the deputy defense minister at the time of the sale, told parliament that Perimekar had received the amount – 11 percent of the sale price of the submarines – for "coordination and support services." The Paris filing alleges that there were neither support nor services. Perimekar was registered in 2001, a few months before the signing of the contracts for the sale, the Paris complaint states. The company, it said flatly, "did not have the financial resources to complete the contract." A review of the accounts in 2001 and 2002, the complaint said, "makes it an obvious fact that this corporation had absolutely no capacity, or legal means or financial ability and/or expertise to support such a contract." "None of the directors and shareholders of Perimekar have the slightest experience in the construction, maintenance or submarine logistics," the complaint adds. "Under the terms of the contract, €114 million were related to the different stages of construction of the submarines." The apparent consideration, supposedly on the part of Perimekar, "would be per diem and Malaysian crews and accommodation costs during their training. There is therefore no link between billing steps and stages of completion of the consideration." As Asia Sentinel reported on April 1, services for the subs are being performed by a well-connected firm called Boustead DCNS, a joint venture between BHIC Defence Technologies Sdn Bhd, a subsidiary of publicly-listed Boustead Heavy Industries Corp Bhd, and DCNS SA, a subsidiary of DCN. Boustead's Heavy Industries Division now includes Perimekar as an "associate of the Group. PSB is involved in the marketing, upgrading, maintenance and related services for the Malaysian maritime defence industry," according to Boustead's annual report. Originally Boustead told the Malaysian Stock Exchange that the service contract was for RM600 million (US$184.1 million) for six years, or US$30.68 million annually. However, the contract later ballooned to RM270 million per year. Boustead Holdings is partly owned by the government and has close connections with UMNO. "There are good grounds to believe that [Perimekar] was created with a single objective: arrange payment of the commission and allocate the amount between different beneficiaries including Malaysian public officials and or Malaysian or foreign intermediaries," the complaint states. Pity the dilligent tax payers in Malaysia, the working masses, who pays income tax thru schedular tax deductions on every monthly paycheck BEFORE getting paid. As a Malaysian citizen, I say equivocally that the three separate bodies Executive, Legislative and Judiciary purporting to uphold the Malaysian Constitution and Democracy–have abetted not only corruption but murder in Malaysia. I am not alone in this deduction -millions of right thinking Malaysians feels the same way. The forefathers of the Malaysian Constitution never taught that the executive will take over all the powers and see that the Legislative body becomes a ‘rubberstamp”, with an impotent Judiciary giving up their power and the fore rolling back democracy. If you are a Malaysian Judge or Legislator-you should be put to shame for your shenanigans. Malaysians want to spit at their leaders if they can. When was it a norm that murderers can get away in Malaysia? We have a Mongolian model, Kugan and Teoh as a few cases showing that Malaysians are living in a Stalinist State. Malaysians are frightened of the Police and Government and fear walking on the streets! The recent riots in Indonesia over the interference of the place of rest of one Arab Islamic Scholar Habib Hasan bin Muhammad Al Hadad is CLEAR evidence of what can transpire if the Malaysian government continues to promote and politicize Islam in a multiracial country. Both Malaysia and Indonesia had racial riots-the Government run by Najib is corrupted-top bottom and MUST GO-No Alternatives-No amnesty for this dishonest regime. I won’t be surprised that the rumors that even the trip to Washington DC was organized by friends of the PM’s wife and not tendered over board thereby making money -not all Bumiputras are equal. Change is necessary in Malaysia –No country in the world can sustain a policy that places one citizen over the other as supreme. That failure was seen in Hitler’s Germany among other more recent countries. Malaysian must have a zero tolerance level for racial discrimination. I hope that the US policy makers will see this and not become like France, a dishonest nation who is making money from countries striving to be like the United States. Malaysia has long ago ceased to keep up the pretence of separation of powers. Watch the second sodomy trial of Anwar Ibrahim - the current leader of the opposition. The entire judicial machinery including the police force is stacked against him. It matters not an iota that the intitial examination of his "victim" failed to establish any evidence of a sexual connection. All the police did was to search around for a compliant medical practitioner willing to testify to the contrary. Any foreign company intending to conduct business in Malaysia needs to be aware that they do so at their own peril. Kickbacks are mandatory if you ever hope to have a presence in malaysia. God help you if you run foul of your malaysian govt-linked partners.

Malaysians have a dream-like Martin Luther King-that perhaps that when the Constitution in America at the time of George Washington was drawn up-that the words all “Men are Equal” would not be mere words but effectively would include the American Indian and the African American. The minority population had to wait many years for change for that to materialize. The African American has evolved from slavery to the President of the United States. That is America. Malaysian must dream like that-we need leaders who are incorruptible and fair to all races and religions. We don’t want to see the Sultan of Selangor and his sister as the main contractors for a failed hospital in Selangor-there is no appeal in health! Corruption of the Royalty has moved from Perak to Selangor. Our PM and his merry men who went to America insist that they would like to be like America, changing their foreign policy from Mahathir’s anti-Semitism to one of inclusion of Judaism and the United States. This is good. But action speaks louder than words. When you make law and paint the school busses “Yellow”, every car must stop when the school bus is picking up children in the USA. In Malaysia, as long as it is colored yellow that is enough. There may be more children on the bus. You can break the speed limit and do all and sundry –so long as the bus is yellow. That is where the difference lies!
The PM of Malaysia is implicated in SERIOUS ALLEGATIONS of TORTURE and MURDER and CORRUPTION-the main issues in France is whether as a HEAD of STATE will he be granted immunity-the answer is no. Do we need a PM who does not want to vindicate himself of these allegations? How can Malaysian have a PM who is involved in this scandal??? Sorry but I was really disappointed with their disdain. Possible though, that their super efficient assistants decided that this matter had no glamour value to become a sensational item. After all why should anyone care for a suffering million in the shadows, when 30 to 40 persons detained by under the ISA, could bring in headlines and score with the majority of the citizens of the blogosphere! Its a sad sad and sick world. Sorry everyone, but really I have lost faith that there genuine unparochial leaders exist in Malaysia. Dont get duped by promises and teary eyed "sincerity". Keep your babies away so that they dont become pawns for cheap photo-op opportunities. In Malaysia, bankrupted persons, are governed by The Office of the Official Assignee. It has shown absolutely no inclination to protect the blighted ones under its wing. Instead, the Official Assignee seems to function as an agent/ bill collector for banks, the Tax Department, other Government bodies and creditors. This entrusted body functions primarily on a legal loophole/ anomaly that Malaysian laws do not facilitate an auto discharge after the mandated 5 year tenure of bankruptcy.
Bankruptcy laws in Malaysia are vicious and unforgiving – like some other laws that have brought the nation to international shame. Here, bankrupts can remain adjudicated so for life, because, an anomaly in the law prevents an auto discharge (even after the adjudicated 5 year tenure). This anomaly is being utilised by rogue syndicates and corrupt Civil Service personnel to extort immense sums of money from the financially fallen. They demand this money in exchange for their services to facilitate a discharge for rightfully due persons. No country in the world demands compensation from even the most vicious of criminals for financial compensation prior to their release from jail. Why then are questionable and sometimes shady creditors given such power to demand full settlement of claimed dues prior to discharge after the 5 year period of bankruptcy? Since the creation of the Bankruptcy Ordinance, Malaysia, in 1967 (52 years ago), there seems little initiative to study, and amend laws to empathise with the plight of a financial causality. Today 200,000 citizens languish in a perpetual virtual prison for adjudicated bankrupts. Tag 4 dependants to each being, and we have a million in distress. This means that the credit causalities of Malaysia are being dumped into virtual dungeons for life. The anomaly in the Bankruptcy Ordinance of Malaysia 1967 will ensure that most of the 200,000 financially fallen causalities of life will languish to a slow death. This is strange for a nation that has so much compassion for road thugs ( mat rempit) and even terrorists from the Jemaah Islamiah league. Amnesty and rehabilitative programmes are being loudly touted for them - yet non criminal victims of a failed financial system are ostracised to die like the lepers of the olden times. and a bad attempt to suggest that it is fair to all. It is NOT. Any policy that allows one race special privileges is racial discrimination. I say that because -an Indian or Chinese must be able to challenge that a contract cannot go to the Sultan of Selangor to build a hospital not because he is not qualified contractor but he does not need the benefits of affirmative action. We must be able to challenge it in the courts, but when the Lord President married outside the country to a young girl and illegally divorced her with impunity for dishonesty, then there is no credibility in the courts-like Najib problem of murder and corruption.

The defence ministers of ASEAN are great pirates. They have the biggest budgets of all and to be a defence minister is a great job to have, whether it pays 10,000/month or 250,000/month. All of them have learned the principle of "one for me, two for you". Hence some defense ministers stay for a very long time, with the conivance of the PM of course. The size of the salary is not important. It is the opportunity and the greed/ego that goes with the job. Where in the world can you find a defence minister who is not very, very rich? Perhaps the countries in East Asia are the exception. There, ministers resign over "small" payments. In SEA, millions change hands and nobody gets caught, or resign. Deals for warships, helicopters and tanks are big item purchases. It is common knowledge that corruption occurs in all the SEA countries. Whether it can(or will be) proved in court is another thing. Of course the lack of evidence does not absolve the minister of corruption. The proof required in court is too strict to be of use in catching the rat. But the smell of rot and corruption is too great to miss. The people can only sit and watch the continuing lantern show.

Just heard on the evening news, DefTech will be getting 7 billions contract for armored carrier, and Eurocopter a 1.6 billions for their helicopters. I thought I heard the figure was 1.2billion in yesterday's news, but maybe they forgot to include some VIP's in the endorsement list. If jet engines can be shipped out of army base and exported illegally out of country (refer news on Tiger jet engines stolen out of RMAF base), I wonder where will these "Eurocopter" will end up ......

How does a Malaysian citizen believe the Prime Minister of Malaysia after reading this article? How? Is he God-why is he not explaining this on Television? These are SERIOUS ALLEGATIONS! We know the history of Malaysia, UMNO, MCA and MIC. All became politicians to make money-from Tan Koon Swan, Daim, Samy Vello-all made money then and the new team now. But I am surprised that no institution in Malaysia has the guts to look into this. We have to go to France. Remember Hong Kong prosecuted Lorraine E Osman who was prosecuted in that country then, for corruption that involved Malaysian taxpayer’s money ( Millions) in bank Bumiputra? Do we need other countries to prosecute our citizens for committing crimes against Malaysia? Malu-lah!

Why should there be any doubt,,,for foreign employees,,enjoying to stay here legally or illegaly. The whole civil service, security personnals and ruling politicians, are corrupted to the roots and it reminds these illegals of how such activities, prevail in their country of domicile, Burma, Indonesia, Bangladesh, Nepal, Cambodia, Pakistan. For these foreigners on such platform,,, its like a "DUCK IN THE WATER" and definitely an Ugly Duck.
As we Malaysians are being submerged in our own country, for not being familiar with such systems and as Anwar said "Foreign Policies have Changed",,,shows creditability to the fact,, it helps the Barisan Nasional politicians and their Rent Seekers,,to flourish on our Tax Monies, through deceiveness. BN is using the Slogan,,, Foreigners as being a security menace in our country,, as an excuse to increase the Defence Budget,,, as what Tony Pus has pointed out, on Escalating Prices of Armoured Vehicles. The other coalition Political Parties in Barisan Nasional are part takers,,, to the division in shares meant for their members. I do not want to jump into conclusions. But if this is the whole truth I am utterly ashamed to be associated to it. How can I be proud that my own country's PM is implicated in such a scandalous and corrupt practice? And one a supposedly impartial judiciary does nothing about? Frankly (and I could say this on behalf of most Malaysians) any lingering hope for change in the judiciary's ways just disappeared. Sadly, it does not surprise me that these allegations have surfaced at a time where the nation's confidence in the judiciary is at an all-time low. I was referring, of course, to the VK Lingam affair. To date I am not aware of anything done pursuant to that matter apart from the Inquiry. It is sending out wrong signals to the people and I am sadly starting to believe they are nothing but muppets of the influential.
I may be 20. And true, being a student, I would not yet fully appreciate the effects it would have on a tax-paying citizen. But surely, if there is no institution which can do anything about such acts of betrayal to the people, we definitely are in a very sorry state of affairs. Change of government in the next election? I am not counting on it. It has never happened in 50+ years of independence and by the looks of this article, the strength of the powerful has empowered them to greater levels to the point where anything (and I mean Anything) can be done to protect the interests of the powerful. I get weary of reading such news every now and then. Hopefully there will be a noteworthy response from the people (or somebody of significance) about this. Ironically, I am a law student. But I rest easy knowing I will not be enticed by the luxury of practicing in these current sad state of affairs. PM please come out and explain.
